Legal News – According to a court document, the securities class-action law firm Levi & Korsinsky has reached a settlement to settle a complaint in which one of the founding partners of the company was accused of retaliating against a lawyer who filed a lawsuit alleging sex discrimination.
Amy Miller, the plaintiff, the company, and founding partners Eduard Korsinsky and Joseph Levi said on Friday that they had reached an agreement that opens a new case for Miller’s complaint to be dismissed from federal court in Manhattan.
They did not provide any further information, but they did consent to Miller’s dismissal “with prejudice,” which means she cannot refile her allegations.
Requests for comment from Korsinsky, Levi, and the lawyers at Epstein Becker & Green did not immediately get a response. In response to similar inquiries, Miller and her attorney, Samuel Maduegbuna, did not reply right away.
Miller currently works as an attorney in New York for Cohen Milstein Sellers & Toll, the plaintiffs’ firm.
Miller, who was a partner at Levi & Korsinsky before, filed a complaint in 2020, claiming that she was let go for asking for a fee-based bonus arrangement that would have put her on level with other male attorneys at the company.
In her lawsuit, she also claimed that she received lesser incentives than the attorneys under her supervision and was excluded from cases that were expected to result in large profits.
Miller earned the highest base pay of any lawyer in the business, Levi & Korsinsky responded, and her termination was due to her aggressive job hunt.
Miller’s “unrelenting belligerent, defiant and disruptive performance and behavior” was cited by the firm.
Miller was allowed to continue with the lawsuit, according to a September ruling by U.S. District Judge Loretta Preska. Additionally, the judge decided that Miller was the target of counterclaims filed by Levi & Korsinsky as retribution for her complaint.
The case is Southern District of New York, U.S. District Court, Miller v. Levi & Korsinsky, No. 1:20-cv-01390.
Samuel Maduegbuna of Maduegbuna Cooper is the plaintiff.
For the defendants, Epstein Becker & Green attorneys Allen Roberts and Jessica Giambrone Palmese
